DMX Misses Court, Hit With Bench Warrant
Tuesday, April 17, 2007 By: Kenny Rodriguez
After missing two consecutive court dates, rapper DMX has been issued a second bench warrant for his arrest stemming from traffic violations.
“In truth, I do not know where he is,” said Murray Richman, DMX’s lawyer. “Why would he be hiding out from a damn traffic infraction?”
Richman said that DMX, born Earl Simmons, was in Arizona when he was supposed to be in court last Tuesday, but had promised to show up the next day to answer charges from a traffic stop in June.
Police officers allege that DMX was speeding, changing lanes dangerously, driving without a seat belt, and carrying a suspended license.
“He said he missed a flight,” Richman explained to the court. “He’s always missing flights.”
After DMX failed to appear in White Plains on Tuesday, Judge Brian Hansbury gave him until 2 p.m. on Wednesday to show up.
When DMX failed to show up again, the judge issued the warrant, which means DMX “can be picked up anytime, and if he’s brought here he can be jailed,” according to Court Clerk Jennifer Ruggiero.
However, the judge has agreed that if Simmons were to show up within two weeks, he would “listen to his reasons” before ordering his $25,000 bond to be forfeited.
DMX was also due in City Court in Yonkers on a charge of driving with a suspended license from October 2006. Judge Charles Wood has also issued a bench warrant in that case.
